§1 General regulations

These General Terms and Conditions apply to all orders placed by private individuals via our online store. Should further contracts arise from this contract, they also apply to these. We do not recognize the terms and conditions of our customers in any case, even if the customer has not expressly objected to our conditions when placing the order, unless it is expressly agreed otherwise in writing.

§2 Submission of offers

Conclusion of the contract

The subject of the contract is the sale of goods.

If an item is placed online by us, the activation of the offer page at Willhaben or on our homepage constitutes a binding offer to conclude a purchase contract under the conditions contained in the item page.

The Willhaben GTC or the terms and conditions of our GTC's apply to the conclusion of the contract.

All documents associated with the offers remain our property and are protected by copyright. All orders require written confirmation on our part. Verbal agreements are not binding in any case and all declarations are only binding if they are confirmed in writing (also by e-mail) by authorized representatives.

§3 Price provisions, availability of goods, quality of goods

§4 Payment

(1) In general, our terms and conditions of order shall apply to payment. If nothing has been specifically agreed, our general payment regulations shall apply.

Payments are to be made within 7 days gross by advance bank transfer or by cash on delivery directly to the parcel delivery service. All costs arising from the aforementioned methods of payment shall be borne by the customer. We do not recognize foreign fees.

Parcels are delivered within the EU with DPD, GLS, DHL or the Austrian Post.

§7 Notice of defects and warranty

We are liable for defects of the goods, which also include the absence of warranted characteristics, as follows:

(2) If the customer does not give us the opportunity to convince ourselves of the defects, in particular if he does not immediately provide the rejected goods or samples thereof upon request, all claims for defects shall lapse. In the event of a justified, immediate notice of defect, we shall take back defective goods and deliver faultless goods in their place.

If we do not comply with the obligation to deliver a replacement or to rectify defects or do not do so in accordance with the contract, the customer shall have the right to reduce the remuneration or, at its option, to rescind the contract.
